As generative AI technology rapidly evolves, computer-generated evidence and deepfakes have become increasingly difficult to distinguish from human-generated content. Given the ubiquity of AI, attorneys need to take this growing technology into account when planning their trial strategy.

This 90-minute program, led by attorney and AI researcher Dr. Maura R. Grossman, will provide plaintiffs’ counsel with essential knowledge about handling AI-generated evidence in court proceedings.

The session will begin with a clear, accessible explanation of AI fundamentals, including predictive and generative AI, as well as deepfakes. Dr. Grossman will then explore the unique evidentiary challenges these technologies present in courtroom settings, particularly in light of the Federal Judicial Conference’s Advisory Committee on Evidence Rules’ discussion of AI-specific revisions to the Federal Rules of Evidence at the recent meeting on May 2, 2025.

Drawing on her extensive expertise in responsible AI and AI as evidence, Dr. Grossman will review the proposed evidence rule changes—including potential new Federal Rule of Evidence 707 that would apply Rule 702’s reliability standards to machine-generated evidence—and will provide practical strategies for attorneys seeking to either admit or challenge AI-generated evidence.
